Twitch – Terms of Service

Dataset: PGAv2 (Platform Governance Archive v2) — 25 platforms, 2022–2026

PGAv2 (Platform Governance Archive v2) is this wiki’s legacy dataset: pre-tagged JSONL records covering 25 major social-media, messaging, and content-sharing platforms, with risk scores and keywords assigned via systematic extraction of 1,736 high-risk clauses from each platform’s Terms of Service, Privacy Policies, and Community Guidelines, spanning 2022–2026.

Note: This page contains documented policy clauses. Risk assessment is qualitative and context-dependent. For analysis of patterns across platforms, see:

Overview

This page covers Twitch’s Terms of Service across 20 scrapes spanning 2022-07-11 to 2025-12-09, with 12 unique snippets. Twitch_Community_Guidelines.jsonl, Twitch_Other.jsonl, and Twitch_Privacy_Policy.jsonl are all empty (0 lines) and have been skipped.

Twitch’s Section 8 “User Content” clause grants Twitch an “unrestricted, worldwide, irrevocable, fully sub-licenseable, nonexclusive, and royalty-free right” over streamed video and other User Content, including the right to use a streamer’s “name, identity, likeness, and voice.” A 2025-04-10 restructuring is the most significant genuine change in this dataset: the clause is split into a heading explicitly titled “License to Twitch & Other Twitch Users”, adding a brand-new sub-clause where, if Twitch’s content-sharing functionality is enabled, a streamer also grants every other Twitch user an identical “worldwide, irrevocable, fully sub-licenseable, nonexclusive, and royalty-free license” to reuse their Content outside the Twitch Services — a newly-confirmed user-to-user grant alongside the platform-to-itself grant. Section 7’s separate “License” clause grants users only a narrow, “non-sublicensable” right to use Twitch’s own site/software, with an extensive list of “Don’ts” (no resale, no derivative works of the Services, no data mining/robots) layered on top.

Flagged Keywords & Risks

The 2025-04-10 restructuring that added the explicit “License to Twitch & Other Twitch Users” sub-clause — extending the same unrestricted, irrevocable, fully sub-licenseable, royalty-free rights to every other Twitch user when sharing functionality is enabled — is a unilateral expansion of who may exploit a streamer’s content, fitting wearetosed’s “rights & liability waivers” category given the breadth of what streamers give up over their own name, identity, likeness, and voice. The “Don’ts” list banning “robot, spider, scraper, crawler, or other automated means” is the kind of explicit scraping prohibition Atkinson (2025) identifies as creating actual notice for any bot that accesses the page, which under Atkinson’s framework would make the restriction enforceable against a scraper’s deployer despite the well-known unenforceability of robots.txt on its own. Soneji et al. (2025) found that the bulk of analyzed clauses favor the service provider; the asymmetry between Twitch’s “unrestricted, irrevocable” license over streamer content and the merely “non-sublicensable” license users get back over the Twitch site itself reflects that same imbalance.
