(2) 2025-12-17 — X broadened the license-grant trigger verbs from “submit, post or display” to “submit, input, create, generate, post, or display” Content (and added “including anything referenced therein” twice) — explicitly extending the same broad, royalty-free, sublicensable, uncompensated license to content a user inputs into or generates with X’s tools, not just content they post. The same scrape also renamed the copyright-reporting form from /forms/dmca to /forms/ipi, added a new clause about EU/UK obligations to enforce against content deemed “harmful” or “unsafe,” and expanded the trademark and paid/advertising-feature language. Everything else — including most of the “new snippets” the raw risk scores would suggest — is scraper window-size variation (the same ~4 paragraphs captured with slightly more or less surrounding text) or cosmetic link/rebrand updates, not new legal terms.

Flagged Keywords & Risks

Atkinson (2025) argues that a scraping prohibition becomes enforceable against a bot’s deployer once the bot has had actual notice of the terms it scraped past — exactly the posture created by X’s “cannot scrape the Services without X’s express written permission” clause, since any AI-training scraper crawling x.com necessarily passes through the page containing that prohibition. The same document’s royalty-free, sublicensable content license — broadened on 2025-12-17 to cover content a user “input[s], create[s], generate[s]” and explicitly extended to “training of our machine learning and artificial intelligence models” with no compensation — falls under wearetosed’s “data sharing & selling” category, since it is the contractual basis for X’s own first-party AI training.
